After legal documents are served, a process server must provide the Affidavit of Service (proof of service). It must be signed, notarized, and filed in court.

Timely service is guaranteed! High Quality Court Services is aware of all the service requirements for various subpoenas.
After legal action starts, a party may issue either a Subpoena ad Testificandum requiring a person or organization to testify in court, or a Subpoena Duces Tecum requiring them to produce evidence or records before the court.
A Deposition Subpoena requires a person, who is not a party to the lawsuit to appear at a deposition as part of the “discovery process” before trial.
Subpoenas are served pursuant to the statutes of the Civil Practice Law and Rules (CPLR) and Federal Rules of Civil Procedure (FRCP). They have their own service time restrictions.

An Order to Show Cause is a time sensitive document signed by a judge. It compels a party to appear and/or adhere to the judge’s demands in the order. The order specifies the court appearance date and how the document is to be served.
High Quality Court Services is knowledgeable of the statutory deadlines for serving and filing of affidavits of service. We assure you that we will provide timely and efficient service.
A Notice of Petition and Petition starts an action by a Petitioner. It must be served in the same way as a Summons and Complaint. A Request for Judicial Intervention must accompany the documents. There is a return court date for Respondents that they must answer.
High Quality Court Services is aware of all proper service requirements. Three copies per tenant/subtenant are required. Attorneys should hold on to the original Notice of Petition and Petition so that it may be used as an exhibit if the Notice of Petition and Petition is needed.

Effective October 14, 2019 – the service requirement for a notice to terminate month-to-month tenancy in New York City will be determined by the length of tenancy:
Notice of Petition and Petition in NYC only:
A Notice of Petition and Petition is the formal notice that initiates a Landlord/Tenant proceeding in court. It lets tenants know why the proceeding has been brought by Landlord. Tenant must respond to the Notice in court. The index number costs $45 and must be purchased before service. If High Quality Court Services is to purchase the index number, the Notice of Petition and Petition must each be under separate legal backs with the name and address of attorney. H Services needs 3 copies per Tenant/Sub-Tenant of Notice of Petition and Petition. High Quality Court Services must be informed if additional mailings are to be made as extra copies are needed. If the action seeks monetary relief, a non-military affidavit is necessary for a Judgment or Default Judgment to be entered and High Quality Court Services needs to be informed at the onset. Once the papers are served, the law mandates High Quality Court Services mail another copy to tenant/sub-tenant within 24 hours and file the Affidavit of Service, along with the original Notice of Petition to the court within 3 days.
Hold-Over Proceedings In NYC and all Landlord/Tenant Proceedings Outside NYC:
All procedures in the above paragraph apply.
In Hold-over proceedings in New York City and all Landlord/Tenant proceedings outside New York City, the Notice of Petition and Petition must be served between 10 and 17 days before the return court date.
The Affidavit of Service must be filed no earlier than 10 days before court date.
Matrimonial Services include separation, divorce, annulment, etc.
Along with the document being served (e.g. Summons and Complaint, Summons with Notice, etc.), Notice of Automatic Orders DRL 236, Notice Concerning Continuation of Health Care Coverage DRL 255(1) and Notice of Guideline Maintenance must be provided.
Should there be a need to enter a default judgment because the defendant did not answer the Complaint, HQ Court Services must have a photograph of the defendant or plaintiff must accompany the server at time of service. Please provide all the information that might help in serving the defendant, such as place of business, hours of availability, daily routine, apartment number, phone number, etc.
Summons and petition must be served based upon the letter preceding the docket number (e.g. V-12345, P-67890, O-09876, F-54321, B-24680):
V – Must be served by in-hand personal delivery only, no sooner than 8 days before hearing date.
B – Must be served by in-hand personal delivery only, no sooner than 20 days before hearing date.
O – Must be served by in-hand personal delivery only, no sooner than 24 hours before hearing date.
P&F – Must be served either by in-hand personal delivery or by suitable age and discretion to a person over 15 years of age living with respondent or co-worker at place of business no sooner than 8 days before hearing date. If served at place of business upon co-worker, then copy of summons and petition must be mailed to respondent’s last known residence address.
Surrogate court documents deal with Estate and Guardianship affairs. Most papers from this court require in-hand-only service to people. As one of the strictest courts, there is no room for error in providing information with such papers.

Citations require service of 10 days’ notice before the court date, and if served outside the State of New York, 20 days’ notice is necessary (can be mailed). Affidavits of service must be filed no earlier than 3business days before court date.
